These Terms of Service govern your access to and use of the Mads for Dogs platform, including the website located at https://madsfordogs.co.uk/, any related web dashboards, and any related services, features, communications, and platform functionality made available by MADS FOR DOGS LTD. 

By accessing, registering for, booking through, browsing, downloading, or otherwise using the Platform, you agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, you must not use the Platform. 

For the purposes of these Terms of Service, the “Platform”, “we”, “us”, and “our” refer to MADS FOR DOGS LTD and the Mads for Dogs website, dashboards, and related services made available through them. 

  1. Scope of the Platform

The Platform is a pet care platform designed to enable users to request, arrange, manage, and monitor dog walking, pet sitting, and related services. 

The Platform may include, without limitation: 

  • user accounts and account dashboards  
  • booking and scheduling functionality  
  • client and service-provider communications  
  • reports, photos, videos, and service records  
  • notifications, reminders, and confirmations  
  • payment-related integrations  
  • web dashboards for authorised operational or franchise users  

Certain features may also be available through related mobile applications. Additional terms, including any applicable End User Licence Agreement, may apply to app use. 

  1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in order to use the Platform. 

By using the Platform, you confirm that: 

  • the information you provide is true, accurate, current, and complete  
  • you are authorised to act on behalf of any person, pet, household, or business account you register or represent  
  • you will use the Platform only for lawful and legitimate purposes  

We may refuse access, suspend accounts, or decline bookings where we reasonably believe that eligibility requirements are not met. 

  1. User Roles

The Platform may support different categories of users, including: 

  • pet owners or clients  
  • dog walkers or sitters  
  • franchise owners or local operational users  
  • super admin or HQ users  
  • other authorised representatives or support users  

Different user types may have different rights, permissions, responsibilities, and access levels within the Platform. Your use of the Platform must remain within the scope of the role, permissions, and territory assigned to you. 

We may modify, restrict, or reclassify access levels where reasonably necessary for operational, compliance, security, or service reasons. 

  1. Account Registration and Security

To access certain features, you may be required to create an account. 

You are responsible for: 

  • maintaining the confidentiality of your login credentials  
  • restricting access to your devices and account  
  • ensuring that all account information remains accurate and up to date  
  • all activity that takes place under your account unless caused by our breach of law or security obligations  

You must notify us promptly if you become aware of any unauthorised access to, misuse of, or security issue affecting your account. 

We reserve the right to suspend, restrict, or terminate accounts where we reasonably believe that account information is false, incomplete, outdated, misleading, compromised, or used in breach of these Terms of Service. 

  1. Nature of the Services and Platform Role

The Platform is intended to facilitate the management, coordination, booking, and operation of pet-care services made available through it. 

Depending on the service model, territory, or booking flow, the Platform may be used to: 

  • display service availability  
  • receive booking requests  
  • confirm or manage bookings  
  • allocate or identify a walker, sitter, or other service provider  
  • process related communications, updates, and records  
  • support operational oversight by authorised franchise or admin personnel  

Unless expressly stated otherwise in a booking flow, service description, or separate written agreement, your use of the Platform does not create an employment, agency, partnership, joint venture, or fiduciary relationship between you and us. 

Nothing in these Terms of Service prevents us from operating through local franchise structures, authorised service providers, contractors, support staff, or technology partners. 

  1. Bookings and Service Requests

Users may be able to request, schedule, confirm, monitor, or manage services through the Platform. 

A booking is not guaranteed until it has been accepted, confirmed, or otherwise marked as booked through the relevant Platform process. 

We reserve the right to reject, cancel, reschedule, suspend, or decline a booking where reasonably necessary, including where: 

  • requested information is incomplete or inaccurate  
  • no suitable service provider is available  
  • there are safety, welfare, access, conduct, payment, compliance, or operational concerns  
  • a booking appears fraudulent, abusive, or technically defective  
  • service delivery becomes impracticable due to events outside reasonable control  

Service times, availability windows, and provider allocation may vary depending on location, demand, user role, and operational considerations. 

  1. User Responsibilities

You agree to use the Platform responsibly and in good faith. 

Without limitation, you must not: 

  • provide false, misleading, outdated, or incomplete information  
  • misuse, disrupt, test, or interfere with the Platform or its security  
  • use the Platform for unlawful, abusive, fraudulent, harmful, or deceptive purposes  
  • attempt to gain unauthorised access to any part of the Platform, another user’s account, or restricted data  
  • copy, scrape, harvest, extract, or reuse Platform data except as expressly permitted  
  • upload harmful code, malware, or other malicious materials  
  • impersonate another person or entity  
  • harass, threaten, abuse, defame, or endanger any user, pet owner, walker, sitter, franchise user, or staff member  
  • use the Platform in a way that infringes privacy, confidentiality, intellectual property, or other legal rights  

You are responsible for ensuring that any information, instructions, access notes, pet details, care requirements, and other materials you submit are accurate and suitable for service delivery. 

  1. Pet Information, Access, and Safety

Where you use the Platform in connection with pet-care services, you must provide complete and accurate information relevant to the service, including where applicable: 

  • pet identity details  
  • breed, age, and behavioural information  
  • medical, medication, welfare, and safety information  
  • emergency contact details  
  • collection, access, location, and household information  
  • any relevant hazards, restrictions, or special instructions  

You must not withhold information that could reasonably affect service suitability, pet welfare, user safety, or the safe delivery of services. 

You acknowledge that service quality, safety, and booking outcomes may be affected by inaccurate or incomplete information supplied by you. 

The Platform is not a veterinary, medical, or emergency-response service. If a pet welfare or personal emergency arises, you should contact an appropriate emergency or veterinary service directly. 

  1. Payments, Fees, and Payment Processing

Certain Platform features or bookings may require payment. 

Where payment applies, you agree to pay all applicable amounts presented to you at the time of booking, checkout, confirmation, or invoicing, including any applicable taxes, commissions, charges, or fees identified during the transaction process. 

Payments may be processed through third-party payment providers, including Stripe and other supported payment methods or app-store payment systems where applicable. We do not store full card details on our Platform where payment processing is handled by an external provider. 

By making a payment through the Platform, you authorise the relevant payment provider to process the transaction in accordance with its own terms and privacy practices. 

We reserve the right to suspend access, refuse bookings, or delay service delivery where payment is declined, reversed, challenged, suspected to be fraudulent, or otherwise fails to clear. 

  1. Cancellations and Refunds

Cancellations, refund requests, refund eligibility, and related processing are governed by our Refund Policy, as updated from time to time. 

By booking through the Platform, you acknowledge that: 

  • refunds are not automatic  
  • change-of-mind refunds may not be available  
  • cancellations may affect refund eligibility  
  • any approved refund may be subject to the terms, timelines, and criteria set out in the Refund Policy  

Where there is any conflict between these Terms of Service and the Refund Policy regarding refund procedure or eligibility, the Refund Policy will apply to the extent of that conflict, unless applicable law requires otherwise. 

  1. Communications, Notifications, and SMS

By using the Platform, you acknowledge that we may send service-related communications through email, in-app notifications, push notifications, platform alerts, and other operational channels connected with your account or booking activity. 

Where you separately opt in, we may also send SMS or MMS messages, including booking reminders, confirmations, alerts, or promotional communications, subject to applicable law and consent requirements. 

Message and data charges may apply depending on your mobile carrier. You may opt out of marketing SMS communications using the method described in the relevant message or by contacting us using the details below. Opting out of non-essential communications may affect your ability to receive certain updates, but will not prevent us from sending communications that are necessary to provide the service, comply with law, protect safety, or administer your account. 

  1. User Content, Reports, Photos, Videos, and Platform Materials

The Platform may allow users to submit, upload, store, or share content, including text, images, videos, reports, records, instructions, or communications. 

You retain ownership of content you lawfully submit, but you grant us a non-exclusive, royalty-free, worldwide licence to host, store, process, reproduce, display, distribute, adapt, and use that content as reasonably necessary to: 

  • operate and provide the Platform  
  • facilitate bookings and service delivery  
  • support communications and user access  
  • maintain records, audits, quality assurance, and dispute handling  
  • investigate complaints, abuse, fraud, or safety issues  
  • comply with law, insurance, or regulatory obligations  

You confirm that you have the right to submit any content you upload and that such content does not infringe the rights of any third party or breach any applicable law. 

We may remove, restrict, refuse, or preserve content where reasonably necessary for moderation, safety, legal compliance, operational integrity, or investigation purposes. 

  1. Intellectual Property

All intellectual property rights in the Platform, including its software, code, design, branding, text, graphics, layout, interfaces, databases, functionality, and underlying materials, are owned by or licensed to MADS FOR DOGS LTD unless otherwise stated. 

Except as expressly permitted under these Terms of Service, you must not copy, reproduce, modify, adapt, distribute, publish, reverse engineer, frame, scrape, mirror, republish, sell, license, or exploit any part of the Platform without our prior written permission. 

Nothing in these Terms of Service transfers any ownership rights to you. 

  1. Mobile Apps and App Store Use

If you access the Platform through a mobile application, your use of the app may also be subject to the applicable End User Licence Agreement and the usage rules, policies, and technical requirements of the relevant app store or mobile operating system provider. 

You are responsible for ensuring that your device, operating system, and software environment are compatible with the app or Platform features you use. 

We do not guarantee that every feature will be available on every device, operating system, location, or app version. 

  1. Third-Party Services and Links

The Platform may rely on, integrate with, or contain links to third-party services, including payment providers, mapping or GPS services, cloud hosting, analytics tools, messaging providers, crash-reporting tools, and app-store services. 

We do not control third-party services and are not responsible for their independent content, policies, availability, or practices. 

Your use of third-party services may also be subject to separate terms and privacy policies issued by those third parties. 

  1. Privacy and Data Protection

Our collection and use of personal data are described in our Privacy Policy. 

By using the Platform, you acknowledge that certain personal, operational, device, booking, pet-related, location-related, and communications data may be processed as necessary to provide Platform functionality, deliver services, maintain records, support safety, handle disputes, and comply with legal obligations. 

Where Platform features involve location tracking, media uploads, reports, communications, or audit records, such processing will be carried out in accordance with the Privacy Policy and applicable law. 

  1. Availability, Changes, and Platform Updates

We may update, modify, suspend, restrict, or discontinue any part of the Platform from time to time, including features, workflows, interfaces, communication methods, service areas, or integrations. 

We do not guarantee uninterrupted or error-free access to the Platform. 

Access may be affected by maintenance, outages, user-device issues, connectivity failures, app-store or third-party service issues, security concerns, legal requirements, or events outside our reasonable control. 

Where reasonably practicable, we may provide notice of material changes, but we are not required to maintain any specific feature, integration, design, or functionality indefinitely. 

  1. Disclaimers

The Platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. 

While we aim to operate the Platform with reasonable care and skill, we do not guarantee that: 

  • the Platform will always be available, uninterrupted, or error-free  
  • all information submitted by users will be accurate or complete  
  • every booking request will be accepted or fulfilled  
  • every service outcome will meet every personal preference or expectation  
  • third-party services or external systems will always function properly  

Nothing in these Terms of Service excludes or limits any rights that cannot lawfully be excluded or limited under applicable law, including mandatory consumer rights. 

  1. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss arising out of or in connection with your use of, or inability to use, the Platform. 

This includes, where permitted by law, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, loss of opportunity, business interruption, or anticipated savings. 

We are not responsible for losses caused by: 

  • inaccurate information provided by users  
  • unauthorised access resulting from your failure to secure your account or device  
  • events outside our reasonable control  
  • failures of third-party systems, payment providers, app stores, hosting providers, mapping tools, or communications networks  
  • user conduct, pet behaviour, or operational circumstances that we could not reasonably prevent  

Nothing in these Terms of Service excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. 

  1. Suspension and Termination

We may suspend, restrict, investigate, or terminate your access to the Platform, your account, or specific features where we reasonably believe that: 

  • you have breached these Terms of Service  
  • your conduct creates legal, operational, fraud, safety, welfare, or reputational risk  
  • your account information is false, compromised, or materially inaccurate  
  • payment issues, chargebacks, abuse, or suspicious activity have occurred  
  • suspension or termination is reasonably necessary to protect users, pets, staff, the Platform, or compliance obligations  

You may stop using the Platform at any time. If you wish to close your account, you should follow the available account-closure or support process. 

Termination or suspension does not affect any rights, obligations, liabilities, accrued charges, investigations, or record-retention rights arising before termination. 

  1. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless MADS FOR DOGS LTD, its officers, employees, contractors, franchise representatives, affiliates, and service partners from and against losses, claims, liabilities, damages, costs, and expenses arising out of or connected with: 

  • your misuse of the Platform  
  • your breach of these Terms of Service  
  • your violation of law or third-party rights  
  • information, content, or instructions you provide through the Platform  
  • your acts, omissions, or conduct in connection with bookings or service delivery  

This section does not apply to the extent that a claim arises from our own breach of law or obligations that cannot legally be excluded. 

  1. Changes to These Terms of Service

We may update these Terms of Service from time to time to reflect changes to the Platform, services, technology, law, business operations, or user experience. 

Where appropriate, we may notify users of material changes through the website, app, dashboard, email, or another reasonable method. 

The updated Terms of Service will take effect from the date stated at the top of the revised document. By continuing to use the Platform after the updated Terms of Service take effect, you agree to be bound by the revised version. 

  1. Severability

If any provision of these Terms of Service is found to be unlawful, invalid, or unenforceable, that provision will be treated as severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. 

  1. Entire Agreement

These Terms of Service, together with any applicable Refund Policy, Privacy Policy, Cookie Policy, Acceptable Use Policy, End User Licence Agreement, and any booking-specific terms expressly presented through the Platform, form the agreement between you and us regarding your use of the Platform, unless a separate written agreement expressly states otherwise. 

  1. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the United Kingdom. 

You and MADS FOR DOGS LTD agree that the courts of the United Kingdom will have jurisdiction over disputes arising out of or in connection with these Terms of Service, subject to any mandatory rights or forum protections available to consumers under applicable law.
